WhatsApp Will Obey Delhi HC Decision to Prohibit the Sharing of User Data


BENGALURU: Previously, the news of WhatsApp’s refusal to accept Delhi High Court’s decision against data sharing was buzzing around the internet. Now, rubbishing the wrong information, the social messaging giant has finally confirmed that it will comply with HC’s order––will not share user data with Facebook as planned earlier.

Recently, a WhatsApp spokesperson stated that, “WhatsApp will comply with the order from the Delhi High Court. We plan to proceed with the privacy policy and terms update in accordance with the Court’s order. The Court’s emphasis on the importance of user choice and consent is encouraging.”

Furthermore, HC had also ordered the social messaging company to delete all data collected upto 25th of September, if the users opt to do so. The motive of this order is to erase all the user data stored under the old privacy policy and bring a new policy into effect. However, the order does not specify any date regarding the process of deleting data. The company has not yet confirmed that if it has started erasing the user data, or has already erased them.

Delhi HC’s divisional bench of Chief Justice G. Rohini and Justice Sangita Dhingra Sehgal also asked WhatsApp to prohibit data sharing. Effectively secured by an end-to-end encryption by default, WhatsApp explained that they had previously planned to share the crucial data such online status, log-records and phone numbers to help Facebook improve their ad experience.

Facing a similar issue in Germany, the German Privacy watchdog instructed Facebook to delete all user-related data received from WhatsApp.
